I initially had no hope that more gun regulation would stop mass shootings because the only way to do this is to completely eliminate guns. My Ideas On How To Limit Mass Shootings AND The Availability Of Gun
Then I began thinking of ideas for gun control, making sure to address the two problems that I see with a total ban:
(1). The virtual impossibility of a constitutional amendment and
(2). The virtual impossibility of dealing with the 300 million guns already out there (plus the black market in guns).
I think the real question is can we really tolerate more of these mass shootings without doing anything to try to prevent them?
It’s comforting that although so many Americans who are polarized on various issues of the day can find common ground to address and rally behind these horrendous acts .

Some People Have And Will Express The Following Concerns:
* Attorney William Crosby, for example, says: “Regardless of the existence of millions of semi-automatic handguns and other assault-type weapons that would be available on the black market, we have to start somewhere. There should be strict licensing requirements for the possession of guns and Draconian penalties for possessing illegal weapons.”
* We do require registration and I don’t think harsher penalties are deterrents to insane shooters who generally kill themselves anyway.
You may have ideas of your own. However, I think these are some interesting ideas on gun control, many revolving around economic incentives and disincentives.
A Nationwide Guns For Cash Program
Assuming assault weapons were banned and people were asked to turn in their guns for cash . You would be surprised what people will do for cash. This will not completely stop the violence but maybe it’s a start, and if we can save just a few children and lives it’s worth it.
LOS ANGELES–A One-Day Gun-Buyback Program In Los Angeles Brought in 2,037 Firearms.
Mayor Antonio Villaraigosa’s office said the weapons collected Wednesday included 901 handguns, 698 rifles, 363 shotguns and 75 assault weapons.
Long lines of cars and people showed up at two locations to exchange their weapons for supermarket gift cards worth as much as $200 depending on the type of gun.
Officials were mindful of both the massacre of students and teachers in Newtown, Conn., and a gunman’s ambush that killed two firefighters in Webster, N.Y.
The buyback is usually held in May but was moved up in response to the Dec. 14 massacre at Sandy Hook Elementary School in Newtown.
“All of us are still mourning the tragedy at Newtown, Conn.,” said Mayor Antonio Villaraigosa. “So many young innocent children were mass-murdered in the way that they were, and now the assassination of two firefighters…just breaks the heart of so many of us, particularly in this holiday season.”
The anonymous buyback program allowed weapons to be turned in with no questions asked.
Reps. Connolly and Deutch Launch Effort to Add Gun Buyback Provision to Fiscal Cliff Deal

Congressman Gerry Connolly’s 11th Congressional District in Northern Virginia includes the headquarters of the NRA. Six of the victims of the 2007 Virginia Tech shootings, including the shooter, were from Connolly’s District. Earlier this week, a column from Connolly on the subject appeared in the New York Times Opinion Pages.
Congressmen Gerry Connolly of Virginia and Ted Deutch of Florida want to see a $200 million gun buyback program added to any final fiscal cliff deal in Congress and they are asking their House colleagues to join them in signing their letter to Speaker John Boehner and Democratic Leader Nancy Pelosi.
“Gun buybacks have proven successful in communities across the nation,” Connolly and Deutch said in a “Dear Colleague” to House members. “Adding $200 million to the final compromise on the fiscal cliff could remove as many as 1 million guns from our streets.” Noting that such programs are supported by law enforcement agencies as a valuable resource for reducing gun violence, the two congressmen said including the gun buyback program in any year-end deal “is a simple, immediate step we can take to assure the public we are committed to taking meaningful action.”
In their letter to Boehner and Pelosi, Connolly and Deutch said federal financial support to help local communities and states conduct buyback programs could also bolster local economic activity. “Distributing funding to the States to run buyback programs using pre-paid debit cards with a three-month expiration date could provide a jolt to local economies that have stagnated in the wake of the recession and concerns over the fiscal cliff.”
“The murder of 20 youngsters and six educators in their classrooms has galvanized the public’s desire for immediate action, and partnering with the States on a nationwide gun buyback program is a modest, common-sense start,” the two congressmen said.

Reenact The Federal Assault Weapons Ban and Make it Law!
Due to the traumatizing events that occurred on December 14, 2012 at 9:30am at Sandy Hook Elementary School in Newtown Connecticut , we the people should fight to have the Federal Assault Weapons Ban reenacted and put into federal law. This ban was put into law on September 13, 1994 and expired September 13, 2004. It made it so people could not hold and sell semi-automatic pistols, rifles and shotguns that met the qualifications of the ban. The ban was part of the Violent Crime Control and Law Enforcement act of 1994 .

There have been many attempts to reenact this bill, but none have made it to the floor of the legislature for a vote. This is where we come in. Due to the tragic events at Sandy Hook , there needs to be action taken by the government regarding assault weapons. What other motive do we need? 27 Innocent lives lost. Innocent, beautiful, children’s lives were lost. YOU by signing this petition can show the government we mean business and we never want a tragedy like what happened at Sandy Hook to happen again.
By putting this ban into law we can do that, and make it much harder for people to attain these weapons of mass murder. Is this in protest of our second amendment rights? No. That’s not what we are out to protest, some guns can be found
to be necessary in some circumstances, but, we want guns that are made to kill scores of people, that can fire and kill multiple rounds in one load, (as classified by the ban) to be off the street.
We want life to continue, like we wish we could have the beautiful children and their teachers killed at Sandy Hook Elementary School in Newtown Connecticut , lives back. We do not need to have our lives disrupted by people with the se types of guns ever again .
And, to those of you who believe that people kill p eople and that guns don’t kill people. You’re right. But, if we ban these special kind s of guns it would make it so much harder for these weapons to get into the hands of these kinds of people who use them irresponsibly.

Three New York City pensions filed shareholder proposals with Mastercard Inc. and American Express Co. urging the credit-card companies to improve tracking of gun sales.
The proposals, by the city pensions for teachers, civil servants and school administrators, asked the boards of both companies to assess and publicly report their decision-making related to the creation of merchant codes for standalone gun and ammunition stores, according to a news release from the city comptroller’s office.
A merchant category code, known as an MCC, is used by credit card companies to classify businesses by the types of goods and services sold.
Clothing, sporting goods stores and transpiration providers have specific MCCs, but standalone gun and ammunition stores don’t. MCCs are created by an industry panel called the International Organization for Standardization.
Creating a new code would be a first step to enable financial institutions to flag unusually large purchases at stores over a short period of time or multiple purchases at different retailers.
Establishing such a merchant category code would be a step toward “preventing gun crimes and saving lives,” Comptroller Brad Lander said in a news release. “Unfortunately, the credit card companies have failed to support this simple, practical, potentially lifesaving tool.”
Seth Eisen, a Mastercard spokesperson, said the ISO is considering a separate MCC code for gun and ammunition stores.
“We are reviewing how it could be implemented and managed by the banks that connect merchants to our network,” Eisen said. “This will help us continue to deliver a payments system that supports all legal purchases while protecting the privacy and decisions of individual cardholders.”
Randi Friedman, an American Express spokesperson, didn’t immediately respond to a request for comment.
The gunman who killed 59 people at a Las Vegas country music festival in 2017 charged almost $95,000 to a credit card for guns and ammunition in the year before the attack, according to a CBS News report.
A man who opened fire at a nightclub in Orlando, Florida, put almost $26,000 on credit cards in 12 days, according to CBS.
The shareholder proposal asks Mastercard and American Express for reports on governance of MCC standards and the disclosure and justification for their position on any application to create an MCC code for gun and ammunition stores. Ignoring or failing to mitigate risks could threaten share-holder value, Lander said.
New York City pension funds for police officers and firefighters didn’t file resolutions. The city’s five pensions oversee about $240 billion of assets.
The city pensions aren’t among the top stockholders in the companies. But the three pension funds own 667,200 thousand shares in American Express valued at approximately $92.49 million; 1.1 million shares in Mastercard worth approximately $347.59 million; and 1.85 million shares in Visa Inc. valued at about $363.86 million.
The pensions didn’t file a shareholder proposal with Visa because the deadline for resolutions passed, according to a spokeswoman for the comptroller.
California’s Teachers’ Retirement System filed similar resolutions with Mastercard, American Express and Visa.

Visa, Mastercard, Amex To Track Gun Shops With New Merchant Code
Move represents win for gun-control advocates, excludes firearms sales at big-box retailers.
Visa Inc., Mastercard Inc. and American Express Co. will add a new merchant category for firearms retailers, a victory for gun-control advocates who have pressed the financial industry to do more to help curb mass shootings.
The new merchant-category code was recently approved by an international entity that sets standards for the payments industry.
Merchant-category codes, or MCCs, are four-digit numbers that networks use to identify types of merchants by the goods and services they sell. Card networks assign specific codes to many kinds of specialty merchants, such as fast-food restaurants, bars and bicycle shops.
Until now, gun shops were often categorized as specialty retailers or durable-goods sellers—categories that include a much broader collection of companies.
The new code is for retailers whose primary business is firearms sales; big-box retailers that sell guns have different MCCs.
Card networks and banks have been discussing ways to monitor gun sales off and on for years. But gun-rights advocates have long resisted such efforts, saying they could unfairly prevent legal gun purchases.
It isn’t clear if or how information gleaned from the new code would be shared with law enforcement. One challenge for payments companies will be determining what kind of gun purchases would be deemed suspicious.
The card networks said they would work to implement the new code while supporting lawful purchases and protecting consumer privacy.
Gun-control advocates recently stepped up their long-running campaign to get banks and credit-card companies to do more to track and flag suspicious firearms sales.
Earlier this month, Democratic lawmakers wrote to Visa, Mastercard and Amex pushing for the implementation of a new MCC for gun and ammunition sellers, citing recent examples of credit cards being used to buy guns that were later used in mass shootings.
A new code for gun retailers would be “an important step towards ending financial system support for gun trafficking, gun violence, and domestic terrorism,” Massachusetts Sen. Elizabeth Warren and Pennsylvania Rep. Madeleine Dean wrote in a letter signed by dozens of other lawmakers.
The attorneys general of New York and California recently asked the card networks to begin tracking gun sales and flagging suspicious purchases to law enforcement.
Financial companies already report potential money laundering and other kinds of criminal activity, they wrote in letters to the three companies, and should do the same for suspicious gun sales.
Banks and other card issuers keep tabs on all sorts of transactions to manage risk and to prevent illegal activity. They have blocked consumer card purchases considered risky or prone to fraud or in a legal gray area. They also act as agents of the government in monitoring payments for suspicious activity, including transactions that could finance terrorism.
The payments industry has long been divided on whether to assign MCCs to gun shops. Some executives in private discussions have flagged concerns that it could lead to the creation of more codes that could be used to crack down on controversial businesses such as abortion providers.

Why Forcing Visa, Mastercard, Amex To Track Gun Shops With New Merchant Code Is Bullish For Bitcoin
Bitcoiners owe Andrew Ross Sorkin a big thank you.
Sorkin has highlighted cryptocurrency’s fundamental value proposition: its cash-like neutrality.
By successfully campaigning to further politicize the payments system, The New York Times columnist just made value-neutral cryptocurrency networks more valuable in the long term.
Sorkin has succeeded in politicizing the payment system and further deputizing financial institutions as unpaid informants for law enforcement. And that, all else equal, is bullish, over the very long term, for bitcoin.
Anyone who holds bitcoin (BTC), monero (XMR) or another censorship-resistant cryptocurrency should be lining up to shake Andrew Ross Sorkin’s hand.
The New York Times columnist took a victory lap this weekend when the International Standards Organization (ISO) created a new merchant category code (MCC) for credit or debit card purchases at gun stores to make those transactions stand out.
Until now, such stores have been included in the broader category of sporting goods stores (code 5941, should you be wondering).
For years Sorkin had been advocating the creation of such a code to help financial institutions flag suspicious activity in the hopes of preventing mass shootings, and criticizing Visa (V) and Mastercard (MA) for resisting such calls.
His campaign followed a Times investigative series on the unwitting role the banking industry played in financing such massacres.
Amalgamated Bank, the union-owned New York lender, applied for the code’s creation earlier this year, was rejected, then tried again. In the wake of the May school shooting in Uvalde, Texas, the second application succeeded.
On the eve of the code’s creation, Sorkin declared that it would “test the resolve of business leaders and their commitment to American lives.”
Never mind that gun buyers trying to fly under the radar now have an incentive to pay with cash (or perhaps cryptocurrency, where it’s accepted), or to make the purchase at Bass Pro Shops rather than a specialist firearms retailer.
Never mind that, as Sorkin acknowledges, it’s an open question whether the code will be used. That’s up to the “acquiring” banks that plug merchants into the card networks.
Shrewd acquirers, subject to audits by Visa and Mastercard, might advise gun-shop clients to start selling tents to justify using a different code.
Never mind that, depending if the code is used and how “suspicious activity” is defined, law-abiding gun buyers could end up the subjects of suspicious activity reports (SAR) filed by bankers erring on the side of caution. Those SARs, including subjects’ sensitive personal information, will sit in a government database for an indefinite period.
The code is also likely to become a “high-risk merchant” category, meaning gun sellers would end up paying steeper fees for access to the card networks, to compensate banks for the added monitoring burden, payments industry veterans said.
To be clear: I am not claiming that Sorkin’s victory will have any direct or immediate effect on the price of any coin. You will find no “trading signals” in this article. I am talking, rather, of second- and third-order effects.
A Dangerous Precedent
Those cheering the ISO’s decision and Sorkin’s crusade should rewatch a classic public service announcement from the 1980s.
A man confronts his son about a box of drug paraphernalia found in the teenager’s closet. “Who taught you how to do this stuff?” asks the father.
“You, alright?” answers the boy. “I learned it by watching you.”
Following a recent U.S. Supreme Court decision, abortion is now illegal or soon to be in more than a dozen states. Lawmakers in some conservative states have floated measures to penalize those who help residents get out-of-state abortions, including by paying for the procedure or travel expenses.
If such laws pass, why shouldn’t those states demand the creation of a special merchant code for abortion clinics (which now presumably fall under 8099, “Health Practitioners, Medical Services – Not Elsewhere Classified”)?
After all, it would help the states flag what would now qualify as “suspicious activity” when, for example, a local resident’s card is charged at an out-of-state family-planning center.
From the perspective of the anti-abortion movement, also known as the pro-life movement, such a code would “test the resolve of business leaders and their commitment to American lives.”
“Don’t give them ideas, Marc,” I hear some of my blue-state brethren saying. I’m not. Andrew Ross Sorkin is giving them ideas, by ratcheting up the trend of commandeering financial infrastructure to achieve political goals outside any democratic legislative process.
What’s next? Will the right wing insist on a merchant code for transgender care clinics (which, in their minds, are practicing child abuse)? Will the left counter with an MCC for books expressing “hate speech,” the better to detect the “extremists” who purchase them?
None of this would be good for the country or for its banking system. But it’d be great for crypto!
Enter Crypto
Bitcoin has no merchant category codes. A transaction is a transaction. As long as you control the private keys to a wallet, the network will follow your instructions to process the payment, no matter if the recipient is a narcoterrorist or a nun.
Of course, the Bitcoin network in its raw form isn’t private. Those who want to cover their tracks on the open ledger have to take extra precautions – or use privacy coins like XMR, which boast stronger cryptographic protections but are harder to buy or sell for cash than BTC. Cryptocurrencies remain a clunky but serviceable solution for the desperate.
So don’t count on a spate of gun shops suddenly accepting crypto payments. Don’t expect slumping coin prices to roar back as a result of Sorkin’s achievement.
I won’t bother looking up what the BTC price did in the days since the ISO caved to the pressure. Trying to draw a straight line between the two would be dumb.
But directionally, Sorkin has highlighted cryptocurrency’s fundamental value proposition: its cash-like neutrality. For that, crypto holders owe him their gratitude.
Visa Warns Merchant Codes Won’t Show Customer Gun Purchases
Visa Inc. warned a new system that gun-control advocates are saying will limit mass shootings might not have the desired effect.
Earlier this month, the International Organization for Standardization approved a new merchant category code, or MCC, that banks will use when processing transactions for gun and ammunition stores.
Gun-control advocates were quick to celebrate the move, arguing it would help banks flag suspicious activity at these retailers.
The problem, Visa says, is when it processes transactions for any merchant it doesn’t have access to data showing what products consumers are actually buying. That means the network and its banking partners would have no idea if a consumer is buying an automatic rifle or safety equipment at these stores.
“We have no visibility into what items a consumer is purchasing — this is true irrespective of which MCC applies to a merchant,” Visa said in a statement on its website.
Many are “advocating the use of MCCs to track gun sales as a potential tool in combating gun violence. That’s not what merchant codes are designed for, nor should they be.”
In recent years, Visa and its rivals have faced repeated criticism over how their networks are used for commerce. The company, for instance, has stopped allowing use of its cards on Pornhub and other sites owned by MindGeek that permit user-generated adult content.
The move came after a New York Times column in 2020 accused Pornhub of distributing videos depicting child abuse and non-consensual violence. All along, though, Visa and its rivals have maintained that they will allow their networks to be used for legal commerce.
“We do not believe private companies should serve as moral arbiters,” Visa said. “Asking private companies to decide what legal products or services can or cannot be bought and from what store sets a dangerous precedent.
Further, it would be an invasion of consumers’ privacy for banks and payment networks to know each of our most personal purchasing habits. Visa is firmly against this.”

If we each have the right to bear arms, is there a constitutional right to a military-style semiautomatic rifle like an AR-15? What about a rocket-propelled grenade launcher? A small tank?
Under current law, the Second Amendment extends only to weapons that are not “unusual” and are “in common use” by law-abiding citizens. Whether that includes AR-15s is a question the Supreme Court has not yet resolved, although the justices have recently been asked to weigh in.
A key question today — though not when the Bill of Rights was ratified — is whether a weapon is ordinarily used for self-defense. That could be what allows legislators to limit the sale of so-called assault rifles, as they did in the 1990s.
The background to the current doctrine is the first modern treatment of the issue by the Supreme Court, a 1939 decision called US v. Miller. At issue was whether Congress had the legal authority to make it a crime to bring a short-barreled shotgun across state lines.
To give you a sense of how different things were with respect to gun issues 84 years ago, the court held unanimously that the Second Amendment didn’t protect the weapon. The opinion was written by Justice James McReynolds, a libertarian whom liberals hated so much that they called him one of the four horsemen of the apocalypse.
In other words, he was the person on the court who would’ve had the most reason to extend the reach of the Second Amendment. And yet he considered it obvious that the right shouldn’t extend that far.
In the opinion, McReynolds went right back to the words of the Second Amendment which says: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”
McReynolds offered a straightforward explanation of the “obvious purpose” of the amendment: “to assure the continuation and render possible the effectiveness of such forces,” namely the militia. Consequently, the Second Amendment “must be interpreted and applied with that end in view.”
As McReynolds accurately noted, the founders, inspired by classical republicanism, distrusted standing armies, which they thought would be tempted to take over the government like the Roman armies of ancient times. They preferred “well regulated” state militias.
Those militias, in turn, were made up of ordinary citizens. And the ordinary citizens in the state militia were expected to provide their own weapons. McReynolds even cited a Massachusetts law that went all the way back to 1649 and specified what sorts of weapons militia members were obligated to own and maintain.
Musketeers were expected to keep muskets, bandoliers, bullets and powder. Then there were “pikemen,” who had to maintain a “pike [a kind of spear], corselet, head-piece, sword, and knapsack.”
From this it followed, for McReynolds, that the Second Amendment protected only weapons that had “some reasonable relationship to the preservation or efficiency of a well regulated militia.” That did not include the short-barreled shotgun, he added. Such a weapon was not “any part of the ordinary military equipment” nor would its use “contribute to the common defense.”
The virtue of the Supreme Court’s 1939 test is that it was at least true to the original meaning of the Second Amendment. Its practical disadvantage, of course, is that if updated to the present, the rule would protect military-style weapons — not only semiautomatic rifles but machine guns, RPG launchers, predator drones, and the like.
Modern gun rights jurisprudence began in 2008, when Justice Antonin Scalia wrote a Supreme Court opinion called District of Columbia v. Heller. That opinion featured the astonishing act (astonishing for an originalist, at least) of reinterpreting the original meaning of the Second Amendment.
This took some jurisprudential jiu-jitsu. Scalia discounted the introductory clause that explains the purpose of amendment as ensuring a well-regulated militia. He shifted the meaning of the right to bear arms to personal self-defense.
Along the way, Scalia made up a new limitation for the newly created right. He represented the Miller precedent as saying the amendment was restricted to “the sorts of weapons … in common use at the time.”
To this he added that there existed a separate English common law tradition of prohibiting people from carrying “dangerous and unusual weapons.”
The court doubled down in 2022 in a landmark decision striking down “localized restrictions” on carrying concealed guns, with Justice Thomas citing an “enduring American tradition permitting public carry.”
Effectively, the court re-made the principle of the 1939 Miller case into an ad hoc rule. Today, the Second Amendment applies to all weapons that ordinary people carry on an ordinary basis for self-defense.
The one good thing — maybe the only good thing — that can be said about the modern rule is that it excludes grenades and tanks. Logically, it should also exclude AR-15s, which are not commonly carried for self-defense.
As with so many other issues, the decisive vote may belong to Justice Brett Kavanaugh. In 2011, when he was a judge on the US Court of Appeals for the DC Circuit, Brett Kavanaugh wrote a dissent arguing that semiautomatic rifles were constitutionally protected, just like semiautomatic handguns. That was at an earlier stage in the history of mass shootings, though, and perhaps his views have evolved.
Here’s hoping that, when the Supreme Court ultimately addresses the issue, the justices can recognize that that AR-15s do not belong in the same category as handguns. They are weapons of war — for, in fact, a well-regulated militia — not for ordinary people to carry for ordinary use.
