Rostin Behnam, the acting chairman of the CFTC, told the Senate Agriculture Committee that the commodities regulator is ready to become the primary federal regulator for digital assets, should Congress expand the agency’s remit.
Behnam was testifying as part of his confirmation hearing to serve a full term as chairman of the agency.
“The CFTC has responsibly and aggressively been pursuing enforcement cases in the digital asset marketplace for a number of years now,” Behnam said, pointing to the agency’s recent settlements with crypto exchange Kraken and stablecoin issuer Tether.
The regulator pointed to the size of the crypto market, noting the overall market capitalization is about $2.7 trillion now, and “nearly 60% were commodities.”
“I think it’s important for this committee to reconsider and consider expanding authority for the CFTC,” Behnam said.
He acknowledged that regulating crypto would be a “departure” from the agency’s historic role as a commodities regulator, but said the sector is important enough that the shift would be warranted.
“Given the size, the scope and the scale of this emerging market, how its interfacing and affecting customers, retail customers, and then with the scale of the growth being so rapid, potential financial stability risks in the future, I think it’s critically important to have a primary cop on the beat and certainly the CFTC is prepared to do that if this committee so wishes,” Behnam said.
Behnam later pointed to digital asset market transactions as posing a risk, including banking and prudential finance risks and clearing and settlement risks.
“We really also need to have a conversation about market regulation and sort of the exchange, the purchase and sale of these coins in a regulatory structure for both securities and commodities,” he said.
Brewing Turf War?
The CFTC’s securities counterpart, the Securities and Exchange Commission (SEC), has also been moving to regulate the crypto market more. Under Chairman Gary Gensler, who took office earlier this year, the SEC has approved new bitcoin futures exchange-traded funds (ETFs), expanding retail exposure to the digital asset sector.
Gensler has indicated that he believes the SEC may be best suited to become the primary cop for crypto.
In various public statements, Gensler has said the SEC should regulate exchanges like Coinbase because they may list securities, and oversee stablecoins, a segment of the crypto market where each token is pegged to a fiat currency like the dollar.
He has said the SEC should also regulate decentralized finance (DeFi), which seeks to recreate some traditional financial tools and platforms without a centralized party in control.
In a congressional hearing, Gensler has also expressed his belief that “most” tokens are securities.
Congress will have to act to clarify regulation of the crypto market. At present, there is no federal regulator for spot crypto markets.
The CFTC has the authority to oversee crypto derivatives markets and fraud within the underlying spot market, while the SEC has the authority to oversee securities and platforms that explicitly seek to list and trade securities.
Most crypto trading platforms are regulated at the state level, meaning they have to secure money transmitter licenses in each state they operate in. This piecemeal approach has received criticism from industry advocates because of the resources needed to secure nearly 50 different licenses.
CFTC Commissioner Says US Regulators Should Issue Clear Guidance Before Punishing Crypto Firms
“What I discourage here at the CFTC is bringing enforcement actions without giving [crypto firms] the tools they need to be compliant,” Commissioner Stump said.
U.S. regulators should issue clear guidance on how crypto rules will be enforced before punishing firms for not following them, Dawn Stump of the U.S. Commodity Futures Trading Commission (CFTC) said in an interview with the Financial Times.
Stump, a commissioner of the derivative market watchdog, said that it is commonplace for the regulator to bring action against a firm without giving them the guidance necessary to comply with the rules concerned.
“What I discourage here at the CFTC is bringing enforcement actions without giving [crypto firms] the tools they need to be compliant,” she said.
As an example of enforcement coming before proper rule making, Stump cited the $1.25 million fine given to crypto exchange Kraken by the CFTC for not registering as a futures broker.
“I would have preferred that we would not have brought those types of cases until we had better defined how they might achieve compliance,” she added.
The points Stump raised represent the ongoing lack of clarity for crypto firms from U.S. regulators particularly given the blurred lines between the purviews of the CFTC and the markets regulator the Securities and Exchange Commission (SEC).
US Senate Confirms CFTC Chair As President Biden Announces Commissioner Picks
At his October confirmation hearing, Rostin Behnam said it was “critically important to have a primary cop on the beat” of an emerging market that included cryptocurrencies and stablecoins.
Congressional lawmakers confirmed the nomination of Rostin Behnam, a commissioner at the Commodity Futures Trading Commission who had been serving as acting chairperson, to assume his position on a more permanent basis.
In a Wednesday evening voice vote, members of the U.S. Senate approved President Joe Biden’s pick to lead the CFTC. Behnam has served as a commissioner since 2017 and acting chair following the departure of Heath Tarbert in January.
At his confirmation hearing before the Senate Committee on Agriculture, Nutrition, and Forestry in October, Behnam requested lawmakers consider expanding the authority of the CFTC, given the emerging digital asset market. He said that the CFTC had been “aggressively pursuing enforcement cases” in the crypto space, likening its approach to police officers doing their duty.
“Given the size, the scope and the scale of this emerging market, how it’s interfacing and affecting retail customers, and with the scale of the growth being so rapid, potential financial stability risks in the future, I think it’s critically important to have a primary cop on the beat,” said Behnam at the time.
The confirmation came the same day President Biden announced his picks for two additional commissioners at the CFTC. A Wednesday notice from the White House shows he plans to nominate Summer Mersinger and Citi managing director Caroline Pham to the regulatory body.
Mersinger served as chief of staff to Commissioner Dawn Stump as well as the director of the Office of Legislative and Intergovernmental Affairs. Both must be confirmed by the Senate.
Only two commissioners are currently serving at the CFTC out of the normal five, and with the expected departure of Stump in February 2022, Biden will have the opportunity to completely reshape the Commission with four open positions.
In September, the U.S. president announced he planned to nominate Emory University law professor Kristin Johnson and Christy Goldsmith Romero, a former senior counsel in the Securities and Exchange Commission’s Enforcement Division.
Such a large change to the CFTC leadership could easily have an impact on the regulation and enforcement of the crypto space. Currently, the Securities and Exchange Commission, the CFTC and the Financial Crimes Enforcement Network handle digital asset regulation in the country, but with different jurisdictional claims, resulting in a patchwork approach companies must navigate to legally operate.
During Benham’s time as acting chair, the Commission slapped Tether and Bitfinex with a $42.5 million fine and reached a settlement with crypto exchange BitMEX to pay a $100 million civil monetary penalty.
CFTC Should Oversee Crypto Spot Markets, Chief Reiterates Before Congress

Commodity Futures Trading Commission (CFTC) Chair Rostin Behnam has made a fresh appeal to Congress to grant his agency authority to oversee crypto spot markets in the U.S.
Behnam, who became the agency’s acting chief last year before being confirmed to a full term heading the federal regulator, told the Senate Agriculture Committee on Wednesday he believes his agency is best placed to monitor trading, reiterating a stance he first took in October.
At present, crypto spot markets are largely regulated at the state level. The CFTC oversees derivatives markets such as bitcoin and ether futures, and the Securities and Exchange Commission oversees tokens believed to be securities, as well as stocks and funds.
“We are past the stage where digital assets and decentralized financial technologies are a research project, sandboxing what may come in the future. The issues are at the front and center of our thinking at the Commission in addition to our traditional regulatory, oversight and enforcement responsibilities,” Behnam said in introductory remarks.
“The CFTC is well situated to play an increasingly central role in overseeing the cash digital asset commodity market.”
The regulator requested that Congress, in addition to granting the CFTC additional authority, also fund the agency with an extra $100 million to properly oversee crypto markets. The agency’s current annual budget is roughly $300 million.
The added funds would go toward building up internal expertise as well as better enforcing the law, Behnam said. During the hearing he said a large part of enforcement actions come from tips and whistleblowers at present, as one example.
Behnam said the agency does not currently have all of the expertise it needs to properly oversee crypto. In response to a question from Sen. Kirsten Gillibrand (D-N.Y.), Behnam said his team does not currently have sufficient resources or knowledge to monitor and protect against cyberattacks in the digital asset sector.
However, in a follow-up response to Sen. Amy Klobuchar (D-Minn.), he said he would be willing to build up his team.
One of the key issues Congress would have to address is just where the CFTC’s jurisdiction ends and where the SEC’s begins.
Behnam acknowledged this during a discussion with Sen. John Hoeven (R-N.D.), saying it is important to draw “clear, distinct lines” between which crypto assets are securities and which are not.
“The most noticeable gap is what constitutes a security and what constitutes a commodity,” he said, adding that “at its core, we are a market regulator … we would build up expertise in places we need it.”
The Dodd-Frank Act reform of traditional markets in the wake of the 2008 financial crisis is a “perfect example” of the type of work the CFTC could engage in for the crypto markets, he said.
The Dodd-Frank Act helped reform derivatives markets (among others) over the past decade.
In addition to his remarks, Behnam also filed a response from the CFTC to a series of questions previously published by the Senate Agriculture Committee, reiterating the same arguments about how the crypto market should be regulated at the federal level.
“In my opinion, there are important principles missing from the current regulatory framework applicable to digital asset markets that we see in other federally regulated markets, particularly ones that primarily cater to retail investors,” Behnam wrote in the document.
“A federal regulatory regime may ensure that certain safeguards are in place to address the risks to individual investors, market integrity and systemic stability. Those safeguards could include pre-trade and post-trade transparency and uniform standards around settlement, data reporting, cyber security and leverage.”
CFTC Chair Asks Congress For Authority To Regulate Some Cryptocurrencies
Lawmakers are considering whether agency needs additional authority to police market.
The head of the Commodity Futures Trading Commission called on lawmakers Wednesday to grant his agency authority to regulate cryptocurrencies such as bitcoin, saying the “speculative fervor” around such assets has left investors in need of protection.
In a hearing before the Senate Agriculture Committee, which oversees derivatives markets, CFTC Chairman Rostin Behnam also echoed the skepticism expressed by his fellow Biden administration regulators about the potential that cryptocurrencies offer.
“My responsibility is to assume that it will continue to take root and that this technology will continue to emerge and wind itself into traditional finance,” Mr. Behnam said in response to a senator’s question about whether cryptocurrency is likely to grow its role in the financial system. “If we don’t approach the technology that way, we run the risk of stability and safety issues and soundness issues.”
Mr. Behnam suggested Congress pass a law that would allow the CFTC to regulate cash markets for certain types of cryptocurrencies—currently the agency is limited to regulating derivatives—and provide it with funding to conduct additional oversight.
Such legislation would aim to fill a regulatory gap, as some types of cryptocurrency claim to fall outside the jurisdiction of the federal government’s other market regulator, the Securities and Exchange Commission.
The hearing came a day after the Justice Department said it seized over $3.6 billion worth of digital currency stolen during a hack of a cryptocurrency exchange, its largest financial seizure ever. Two suspects were arrested for allegedly trying to launder the proceeds.
Regulators in the Biden administration have likened the roughly $2 trillion cryptocurrency market to the Wild West and said it lacks the safeguards that protect investors in stocks, bonds or commodities.
But they have struggled to apply the decades-old laws that govern those markets to the cryptocurrency industry, which is furiously lobbying Washington to avoid being regulated by the SEC.
Both the CFTC and SEC cracked down on cryptocurrency projects and trading platforms they have considered to be breaking the law or defrauding investors. But neither agency has won undisputed oversight over the two largest cryptocurrencies: bitcoin and ether, which together represent about 60% of the entire market.
That is because of two things.
First, many lawyers believe bitcoin and ether are, for legal purposes, commodities that fall outside the SEC’s jurisdiction.
Second, the CFTC only has the power to regulate derivatives—such as futures and swaps—as opposed to cash or spot markets where the underlying assets are bought and sold.
“There is no one regulator, either state or federal, with sufficient visibility into digital-asset commodity trading activity to fully police conflicts of interest and deceptive trading practices impacting retail customers,” Mr. Behnam said in his prepared testimony.
The Senate Agriculture Committee, which along with its counterpart in the House oversees the CFTC, has begun considering the possibility of granting the agency that authority through legislation.
The top-ranking Republicans and Democrats on both the House and Senate panels sent Mr. Behnam a letter last month asking whether he saw any shortfalls in the CFTC’s ability to police cryptocurrencies.
“Congress must work with regulators and the Biden Administration to design a framework that protects consumers and our environment and keeps our markets fair, transparent and competitive,” Sen. Debbie Stabenow (D., Mich.), the head of the committee, said Wednesday.
Mr. Behnam said the cash market for cryptocurrencies would benefit from CFTC oversight. Cash markets for other commodities, such as corn and oil, are dominated by companies. In contrast, the cryptocurrency market is full of individual investors.
These investors often take on high amounts of leverage to trade. They also entrust their crypto tokens to trading platforms that have frequently lost funds to hacks and poor cybersecurity.
“The CFTC is well situated to play an increasingly central role in overseeing the cash digital-asset commodity market,” he said.
After objecting for years to meaningful federal oversight, cryptocurrency lobbyists have recently shifted their focus to convincing lawmakers and regulators that the CFTC should have primary jurisdiction over their industry.
They say the SEC’s rules for traditional securities like stocks and bonds would be impossible for most cryptocurrencies and trading platforms to comply with, as they impose significant disclosure requirements and liability upon issuers.
“I think the CFTC is in a very strong position to do this,” said Sam Bankman-Fried, the billionaire founder of cryptocurrency trading platform FTX, at Wednesday’s hearing. “I would love to see that jurisdiction expand to be able to provide federal oversight for the cash markets similar to how they do for derivatives markets today, both to provide consumer protection, protect against systemic risks, and provide a clear and consistent framework for the industry.”
US Lawmakers Reintroduce Bill To Give CFTC Crypto Spot Market Oversight
The Digital Commodity Exchange Act would give the regulator direct oversight of some types of crypto transactions and exchanges.
A bipartisan set of U.S. lawmakers are introducing a bill that would give the Commodity Futures Trading Commission (CFTC) a greater role in overseeing crypto spot markets.
The Digital Commodity Exchange Act of 2022 (DCEA), introduced Thursday by representatives Glenn Thompson (R-Pa.), Ro Khanna (D-Calif.) Tom Emmer (R-Minn.) and Darren Soto (D-Fla.), would create a definition for “digital commodity” and allow the CFTC to oversee companies issuing or letting people trade these types of tokens, while having the Securities and Exchange Commission (SEC) continue to oversee tokens that fall under U.S. securities laws.
“The term ‘digital commodity’ means any form of fungible intangible personal property that can be exclusively possessed and transferred person to person without necessary reliance on an intermediary,” a copy of the bill said.
The definition would not include any equity or debt interests, or securities (defined as “a profit or revenue share derived solely from the managerial efforts of others” in the bill). In other words, the SEC would continue to enjoy its own oversight over aspects of the crypto market.
These digital commodities could only be sold on a CFTC-registered exchange, which would have to abide by certain requirements which include holding customers’ crypto in qualified custodians, safeguarding customer assets and prevent commingling customer and corporate funds, according to the bill.
This year’s version of the DCEA is an updated version of a bill originally introduced in 2020 by former Rep. Michael Conaway (R-Texas). Members of the House Agriculture Committee, where Thompson is the ranking member, introduced an updated version last year.
In a statement Thursday, Thompson said the bill was “a culmination of years of work.”

Bipartisan Bill To Give CFTC Authority Over Exchanges And Stablecoins
The Digital Commodity Exchange Act would give the commodities regulator the authority to determine rules for cryptocurrency developers and exchanges offering spot trading.
A bipartisan group of lawmakers in Washington, D.C., introduced an updated bill on Thursday to regulate cryptocurrency developers, dealers, exchanges and stablecoin providers, bringing them under the regulatory control of the United States Commodity Futures Trading Commission (CFTC).
The Digital Commodity Exchange Act of 2022 (DCEA) was re-introduced to Congress by Republican Representatives Glenn Thompson and Tom Emmer with support from Democrat co-sponsors Darren Soto and Ro Khanna.
The updated version includes a section covering stablecoin providers, who can register as a “fixed-value digital commodity operator.” These operators would be obligated to share how the stablecoin operates, retaining records for the regulator along with providing information on the assets backing the “fixed-value digital commodity” and how they’re secured.
As per the last bill, the DCEA would authorize the CFTC to register and regulate cryptocurrency exchanges that offer spot trading of crypto commodities — those that allow traders to buy cryptocurrencies at the current price.
The DCEA would not affect the U.S. Securities and Exchange Commission’s (SEC) regulatory power over digital asset securities offerings but instead, classify cryptocurrencies that are not securities as digital commodities to be brought under regulation by the CFTC.
Crypto exchanges would also be subject to the same rules as other commodity providers for listing new cryptocurrencies on their platforms. Exchanges must demonstrate the crypto is “not readily susceptible to manipulation” by analyzing its mechanics such as its “purpose, functionality, governance structure, distribution, and participation.”
Developers of cryptocurrencies could also voluntarily register with the CFTC and make disclosures required for public trading and listing on an exchange.
A summary of the act says registration would ensure accuracy of records and public information about the crypto is standardized and could help facilitate public exchange listings.
Regulatory uncertainty has afflicted cryptocurrency businesses operating in the U.S., and in a release the co-sponsors of the bill said it would help with easing the prevailing uncertainty of the current rules, with Soto saying:
“Regulatory clarity is critical for digital commodity markets to promote innovation and consumer protection. Innovators are spending up to fifty percent of start-up costs on legal fees because of the current regulatory ambiguity between what is a security and what is a commodity.”
Industry advocacy body, the Crypto Council for Innovation, called the bill “a step forward,” as it creates a “new atmosphere of opportunity without stifling innovation,” adding:
“This is one of a few bills introduced that the industry should watch closely.”
In February, CFTC chair Rostin Behnam told lawmakers during a Senate hearing on digital assets that the Commission had a lack of authority to enforce the crypto space due to differing regulations.
Behnam called the crypto space “in essence […] an unregulated market” and said more regulatory authority for the CFTC “will only allow us to see what’s going on underneath the hood.”
The bill will need to move forward to a hearing by the Agriculture Committee. If passed by the House, it will then be taken up by the Senate Agriculture Committee for discussion.
Chairs From The SEC And CFTC Talk Crypto Regulation At ISDA Meeting

The annual meeting of the International Swaps and Derivatives Association (ISDA) began Wednesday in Madrid. United States Securities and Exchange Commission (SEC) Chair Gary Gensler and U.S. Commodity Futures Trading Commission (CFTC) Chair Rostin Behnam were both featured as keynote speakers at the event, with Behnam speaking at the morning session and Gensler in the afternoon.
Behnam spoke at length about “a request for an amended order of registration as a derivatives clearing organization (DCO) by an entity seeking to offer non-intermediated clearing of margined products to retail participants,” which was transparently a reference to FTX US’s request.
“As other registered entities have expressed interest in exploring similar models, and given the potential impact on clearing members and FCMs [futures commission merchants] […] it is paramount to be transparent and provide an opportunity to hear from the public,” Behnam said, plugging the CFTC roundtable on the subject coming up later this month.
FTX CEO Sam Bankman-Fried may have been listening as Behnam spoke, as Bankman-Fried was present at the conference and participated in a fireside chat a few hours later.
Behnam Went On To Recall His February Senate Testimony To Say:
“I will continue advocating for and supporting legislative authority for the CFTC to develop a regulatory framework for the cash digital asset commodity market.”
Currently, the CFTC only regulates derivatives markets, although it has exerted enforcement authority over cash markets, such as the fine it imposed on Coinbase for improper reporting of exchange volume and “self-trading” in 2021.
Gensler spoke about “the intersection of crypto assets with derivatives” in his significantly shorter speech. He said:
“If platforms — whether in the decentralized or centralized finance space — offer security-based swaps, they are implicated by the securities laws and must work within our securities regime.”
Gensler stressed the need for the ISDA “to recognize that if the underlying asset is a security, the derivative must comply with securities regulations” as it develops legal standards for crypto derivatives.
Commissioner Kristin Johnson To sponsor CFTC Market Risk Advisory Committee
The crypto hawk Biden appointee will sponsor a panel of 36 financial industry executives, thought leaders and other prominent figures.
United States Commodity Futures Trading Commission (CFTC) commissioner Kristin N. Johnson was named the sponsor of the agency’s Market Risk Advisory Committee (MRAC) on Tuesday. She replaced CFTC chair Rostin Behnam in that role.
Johnson was nominated to be a CFTC commissioner by U.S. President Joe Biden in September 2021, concurrent to the nominations of commissioner Christy Goldsmith Romero and acting chairman Behnam as the permanent chair.
Johnson was sworn in on March 30. She moved into the position after spending over a decade as a law professor. Johnson is the author of academic papers in which she has advocated for stricter controls over cryptocurrency. Johnson said in a statement:
“Having spent my career in risk management oversight, I appreciate the MRAC’s significant and critical role in advising the Commission on risk management in our markets including the emerging decentralized market structures in digital asset or cryptocurrency markets that may not rely on intermediation.”
Sponsorships were allotted among the five CFTC commissioners Tuesday for five out of the six CFTC committees, with the exception being the CFTC-SEC Joint Advisory Committee. The MRAC is made up of 36 industry leaders in derivatives and other financial markets as well as academics and regulators.
It includes members of the Federal Reserve Banks of New York and Chicago, HSBC chief operating officer Chris Dickens, Goldman Sachs managing director Amy Hong, BlackRock managing director Eileen Kiely and members of the Futures Industry Association.
Johnson will give the keynote address “exploring an appropriate regulatory framework for [..] the burgeoning decentralized digital asset market” at the FIA’s International Derivatives Expo in London on June 8.
CFTC Sues Gemini Claiming Crypto Exchange Lied In Futures Contract Evaluation
The agency says the exchange gave false information in person and in documents in its 2017 bid to be among the first to offer Bitcoin futures contracts.
The United States Commodity Futures Trading Commission (CFTC) filed suit against Gemini Trust Co. in the U.S. Southern District Court of New York on Thursday.
The CFTC claimed in the civil suit that Gemini made false or misleading statements to the CFTC in 2017 during in-person meetings and in documents, violating the Commodity Exchange Act and other regulations.
The agency was making an evaluation of the potential self-certification of a Bitcoin (BTC) futures contract to be based on the spot Bitcoin price determined by an auction held on Gemini’s digital asset trading platform.
The CFTC was considering whether the proposed Bitcoin futures contract would be susceptible to manipulation. The proposed Bitcoin futures contract would have been among the first digital asset futures contracts listed.
Gemini is the cryptocurrency trading platform founded by brothers Cameron and Tyler Winklevoss. It announced staff cuts Thursday and is preparing to lay off 10% of its workers due to the crypto market downturn.
The CFTC said in a statement that it is seeking disgorgement of ill-gotten gains, monetary penalties and injunctions relating to registration and trading and against further violations of the Commodity Exchange Act.
“This enforcement action sends a strong message that the Commission will act to safeguard the integrity of the market oversight process,” CFTC acting director of enforcement Gretchen Lowe said in the statement.

Bitcoin futures began trading on the CBOE on December 10, 2017, based on the price of the cryptocurrency on the Gemini exchange.
CFTC Chairman ‘Encouraged’ By Bill In Congress To Give The Agency More Crypto Oversight
Rostin Behnam noted the bill would allow the CFTC to assess fees on the industry.
Rostin Behnam, chairman of the Commodity Futures Trading Commission (CFTC), said Thursday that he is “very encouraged” that Congress is making moves to grant his agency more authority over digital asset markets.
“It’s just a positive momentum, I think, for the technology, for the industry, for the economy,” Behnam said at CoinDesk’s Consensus 2022 in Austin, Texas,. “There are unique coalitions getting together on this issue, which is very rare in Washington.”
The CFTC – typically seen as a friendlier option than the U.S. Securities and Exchange Commission (SEC) to lead oversight of the industry – has been tackling a few policy questions, such as crypto exchange FTX’s bid to directly clear customers’ derivatives, but it’s otherwise waiting for Congress to define its eventual role.
That process took a major step earlier this week with the introduction of sweeping legislation from U.S. Sens. Cynthia Lummis (R-Wyo.) and Kirsten Gillibrand (D-N.Y.)
A key aspect of that effort, Behnam said, is the power it gives the CFTC to assess fees on the industry, which would pay for new staff at the agency.
“It allows us to essentially do our job,” he said. “We have to evolve with markets. We have to evolve with technology.”
The recent meltdown of TerraUSD (UST) shows the need for regulation, Behnam said, noting the “terrific fall in price” of the algorithmic stablecoin.
“It validates what has been said, what I’ve said, for the past couple of years,” he said. “We need to put guardrails around the space.”
Gensler Appeals For ‘One Rule Book’ In Negotiations With CFTC Over Crypto Regulation
In an interview with The Financial Times, SEC chair Gary Gensler said he is working on a memorandum of understanding with the agency’s digital asset market co-regulator.
United States Securities and Exchange Commission (SEC) chair Gary Gensler is in talks with Commodity Futures Trading Commission (CFTC) officials on a “memorandum of understanding” on the regulation of digital assets.
Together, the agencies can assure market integrity, Gensler told The Financial Times in an interview published Thursday.
“I’m talking about one rule book on the exchange that protects all trading regardless of the pair — [be it] a security token versus security token, security token versus commodity token, commodity token versus commodity token,” Gensler told the newspaper.
Gensler’s desire to be collaborative comes as a variety of legislative initiatives have been introduced to create a more comprehensive regulatory framework for digital assets.
The Digital Commodity Exchange Act, introduced in its latest form in April, and the Responsible Financial Innovation Act, introduced in June, both gave the CFTC greater authority over the market.
Debbie Stabenow, chairman of the Senate Agriculture Committee, which has oversight of the CFTC, and the committee’s ranking member John Boozman are reportedly also drafting a crypto regulation bill, which is expected to expand CFTC powers.
Gensler, who headed the CFTC from 2009 to 2013, has expressed skepticism about changes in the status quo.
The SEC has taken the lead in crypto regulation so far, but frequently to the dissatisfaction of the industry and lawmakers who are critical of its methods of allegedly regulating through enforcement. Crypto industry leaders have explicitly asked for clearer regulation, and SEC commissioner Hester Peirce has pressed for policy changes from within the commission.
Regulation is not a question of authority alone. The Financial Times cites blockchain analytics company Elliptic as saying U.S. regulators have collected $3.35 billion through enforcement actions in the crypto industry over the years, with over 70% of that sum going to the SEC.
CFTC Labels 34 Crypto And Forex Firms As Unregistered Foreign Entities
“Customers engaged in transactions with these entities may not receive the benefit of the customer protections, safeguards, and guardrails,” said CFTC commissioner Kristin Johnson.
The United States Commodity Futures Trading Commission, or CFTC, has added 34 unregistered foreign entities to its Registration Deficient List, including at least six providing crypto-related services.
In a Thursday announcement, the CFTC said it had expanded its list of firms that it requires to register with the CFTC for providing services including trading binary options, foreign currency or other products such as cryptocurrencies.
The additions to the Registration Deficient List, or RED list, include B.O TradeFinancials, CryptoBO, Bitpay Options, CryptoSphereFX, Direct Cryptos and Prime Crypto FX.
Since 2015, the CFTC has placed 202 companies on the RED List, warning U.S.-based investors to be cautious “when participating in products or markets that historically have seen a large number of fraud complaints.”
Some of the websites linked to the crypto firms added on Thursday were not live at the time of publication.
“Because they are not registered with the CFTC, customers engaged in transactions with these entities may not receive the benefit of the customer protections, safeguards and guardrails long-adopted and deeply embedded in the CFTC’s oversight of the markets,” said CFTC commissioner Kristin Johnson. “Transacting with unregistered entities, particularly those operating without such oversight and beyond our borders, may expose U.S. customers to significant and concerning risks.”
Along with the Securities and Exchange Commission, the CFTC is one of the few U.S. government departments with the authority to bring enforcement actions in cases involving crypto firms.
However, due to the lack of a clear framework for digital assets, many industry experts have voiced concerns about the patchwork nature of regulations needed to operate in the United States.
In June, lawmakers introduced a bill aimed at addressing how the SEC and CFTC could handle different responsibilities in the digital asset space.
CFTC Will Remodel LabCFTC, Education Office To Increase Regulatory Efficiency

The United States Commodity Futures Trading Commission (CFTC), the regulatory agency that shares primary crypto regulatory responsibility with the Securities and Exchange Commission, will undergo restructuring to become more proactive and comprehensive, CFTC chair Rostin Behnam announced on Monday.
LabCFTC, which was described as “the focal point for the CFTC’s efforts to promote responsible fintech innovation,” will become the Office of Technology Innovation (OTI) and report directly to the chairman’s office.
“We are now engaged in a more proactive and comprehensive effort across the agency to regulate these markets with the tools currently available to us,” Behnam said at a Brookings Institute webinar. “Our core policy divisions are now directly addressing how the CFTC can leverage our existing authority to bring important regulatory protections to this market.”
In addition, the commission’s Office of Customer Education and Outreach will be “realigned” within the Office of Public Affairs to better serve new retail participants in the market.
The high level of retail participants distinguishes the digital assets market from other commodities, Behnam observed, citing CFTC studies:
“Trading indicative of retail participants makes up approximately 25% of long open interest in the Bitcoin futures market.”
Behnam also noted regulators’ “collective analysis paralysis” while financial technology has surged ahead. Behnam was not always as calmly resigned to working within the agency’s current authorities, which lack market surveillance and oversight abilities, as he showed himself to be today.
In February, he told the Senate Committee on Agriculture, Nutrition, and Forestry, which oversees his agency, that its dependence on tips and whistleblowers to uncover illicit activity resulted i “a very, very narrow lens into what is actually happening in the market.”
Legislative proposals, such as the Lummis-Gillibrand bill and Digital Commodity Exchange Act grant the CTFC more authority over crypto markets.
US CFTC To Intensify Crypto Work With New Tech Innovation Office
The derivatives regulator is upgrading its LabCFTC to an Office of Technology Innovation as cryptocurrency oversight outgrows the sandbox phase, said CFTC chief Rostin Behnam.
One of the top U.S. crypto regulators, the Commodity Futures Trading Commission, is adding firepower to its oversight by creating a new Office of Technology Innovation, said agency chief Rostin Behnam.
The agency’s LabCFTC, a long-running fintech team, will be transformed into the new office, which will be led by a director that reports to Behnam, he said in remarks prepared for a Brookings Institution event on Monday.
The office will also be staffed by specialists, and existing CFTC employees will have a chance to rotate through to get crypto experience.
“We have moved past the stage of digital assets as a research project,” Behnam said.
He said the scale of the market, the vulnerability of retail investors and crypto’s recent, costly setbacks have lent urgency to U.S. efforts to regulate.
While he praised legislative efforts to deal with crypto, he suggested his agency is “thinking creatively” about ways to address the sector without new congressional authorization.
“Regulators must be nimble, and new challenges may require us to dig deeper, take a different look into how our organic statutes promote our growth alongside the markets we regulate,” Behnam said. “In the absence of new legislative authority, we at the CFTC continue to look at how we can work to protect markets and investors within the bounds of our existing authority.”
CFTC Announces New Tech Innovation Office To Oversee Crypto
As the CFTC looks to play a bigger role in regulating crypto, the Commission’s chief announced plans to onboard industry experts and improve its team of technologists.
The regulator which could soon be responsible for more of the US’s crypto oversight is beefing up its technology team, the agency’s chief said on Monday.
The Commodities and Futures Trading Commission (CFTC), which stands to gain greater authority over digital assets under the proposals of a bipartisan congressional bill, is setting up a new Office of Technology Innovation.
“We are past the incubator stage, and digital assets and decentralized technologies have outgrown their sandboxes,” said CFTC chief Rostin Behnam of the decision, while speaking at a Brookings Institution event yesterday.
The new office will replace the CFTC’s existing fintech team, called the LabCFTC, a project which was the brainchild of Behnam’s predecessor Christopher J. Giancarlo. The former CFTC Chairman is also a blockchain advocate who has embraced the nickname “Crypto Dad.”
Once the rebranding to the Office of Technology Innovation and reorganized is complete, the unit will be headed up by a director reporting to Behnam’s office.
As well as employing specialists in the field, the office will give CFTC staff the chance to rotate through and gain experience in crypto.
Behnam was speaking at a time when his agency looks set to take on more responsibility for crypto, marking a change from the current status quo in which the Securities and Exchange Commission (SEC) has led the charge.
A House bill called the Responsible Financial Innovation Act, which is co-sponsored by Senator Kirsten Gillibrand (D-NY) and Senator Cynthia Lummis (R-WY), would see the CFTC lead oversight on “fungible digital assets which are not securities.”
The bill is expected to go before the Congressional Agriculture Committee, which oversees commodities markets because of its historic role in grain futures markets. It may also move to a vote as soon as this year, according to Gillibrand.
Behnam said yesterday that he was “encouraged” by legislative efforts to create a more consistent regulatory approach.
“Even the strongest co-operative relationships may not yield the efficiency we need to put hard and fast stops to misconduct that increasingly has impacts beyond individual investors,” he said.
“The lack of a comprehensive regulatory regime, applicable to businesses operating in the digital asset market has led to inconsistent practices around issues such as trade settlement, conflicts of interest, data reporting, and cybersecurity.”
CFTC Poaches Pantera Capital’s Legal Counsel, Citing Digital Asset Experience
Joe Cisewski formerly provided Pantera Capital with legal and regulatory guidance relating to the firm’s funds and investment advisers.
Commodity Futures Trading Commission (CFTC) commissioner Goldsmith Romero cited Joe Cisewski’s experience in digital assets as a key reason behind onboarding him as chief of staff and senior counsel.
Announcing the move on Tuesday, commissioner Romero pointed to Cisewski’s 14 years of experience working across the CFTC, Securities and Exchange Commission (SEC) and crypto venture fund Pantera Capital.
“Joe’s unique combination of public and private sector experiences will serve us well as we take bold steps to ensure the resilience of our markets, protect investors and market participants,” she said, adding:
“His fluency on digital-assets and other issues will be valuable as the Technology Advisory Committee embarks on its agenda later this year.”
Prior to this new role, Cisewski most recently served as the general counsel to Pantera Capital, which claims to have 100 venture investments and $5.1 billion assets under management (AUM).
He provided the firm with legal and regulatory guidance relating to the firm’s funds and investment advisers, while also engaging with regulators over Pantera’s projects and portfolio companies.
In May, Cisewski attended a roundtable between crypto industry professionals and the CFTC in which potential regulation relating to the clearing of margin products (including crypto) without a futures commission merchant (FCM) intermediary was discussed.
In his previous stint at the CFTC, Cisewski served as the senior special Counsel and policy adviser to former commissioner Mark Wetjen, who, similarly to Cisewki, left the public sector to take up a role at major crypto exchange FTX as its head of policy and regulatory strategy late last year.
CFTC And Crypto
Alongside the SEC, the CFTC shares a major role in the regulation of crypto in the United States, and its role could soon outweigh that of the SEC’s if the Responsible Financial Innovation Act tabled by crypto-friendly senators Cynthia Lummis and Kirsten Gillibrand is enacted next year.
The two senators have repeatedly said that most crypto assets would be classified as commodities, and should that hold true, it would effectively give the CFTC a broader jurisdiction over the sector than the SEC.
As previously reported, CFTC chair Rostin Behnam announced on Monday that the regulator was expanding the scope of its fintech-focused LabCFTC unit to fall under the Office of Technology Innovation (OTI).
Behnam stated that CFTC is ramping up its focus to provide “important regulatory protections” for commodities markets, including crypto.
“We are now engaged in a more proactive and comprehensive effort across the agency to regulate these markets with the tools currently available to us,” Behnam said.
